Terms and conditions

These terms are the agreement between you and Altiora Holdings Ltd for the Nothing Unsaid app and this website. By creating an account you accept them.

Please read the section about what Unsaid is not. It matters more here than in most apps.

Who we are

What the service does

You check in to say you are okay. You write messages and choose who should receive each one. You choose how many check-ins in a row you can miss, from three to ten.

If you miss that many in a row, we email each recipient of each active message a link to it. One check-in at any point resets the count. You can pause check-ins while you are away, and stop a delivery that has not yet gone out using emergency cancel.

What Unsaid is not

  • It is not a will. A will in England and Wales must be signed and witnessed under the Wills Act 1837. Nothing you write in Unsaid transfers property, appoints anyone, or changes a will you already have.
  • It is not legal, financial or medical advice.
  • It is not an emergency or medical alert service. Nobody is watching your check-ins in real time, and no one is dispatched if you miss one. In an emergency call 999.
  • It is not a guarantee of delivery. We work hard to deliver, but email can fail, an address can stop working, and a recipient may not open the link. Keep anything critical somewhere else as well.

Your account

You must be 18 or over. Keep your password to yourself, give us an email address you can actually reach, and keep your recipients up to date. Messages are only as good as the addresses you give us.

Your content stays yours

Everything you write or upload remains yours. You give us permission only to store it, encrypt it, and deliver it to the people you chose, for as long as you keep your account.

You are responsible for what you write. Do not use Unsaid for anything unlawful, threatening or harassing, or to send anything you have no right to share.

The people you name

When you give us someone's contact details, you confirm that you are entitled to share them with us for this purpose, and that you are comfortable with them receiving what you have written when delivery is triggered.

If a recipient asks us to stop contacting them, we will remove them and tell you to choose someone else.

Sealed sections

When you seal part of a message, the unlock key is wrapped with the answers you set and we discard the plain key. We cannot open it, recover it, reset it, or help anyone guess it.

If the answers are forgotten or the recipient cannot provide them, that content is lost permanently. Please choose questions the right person will still be able to answer years from now.

Security

We encrypt your messages in transit and at rest, restrict and log access to production systems, and keep everything in the United Kingdom. Sealed sections are encrypted so that we cannot open them.

No service can promise perfect security. Keep a password you do not reuse, keep your phone locked, and tell us at hello@nothingunsaid.app if you think an account has been compromised or you have found a flaw.

Plans and payment

There is a free plan. Paid plans are sold through the App Store, so Apple takes your payment and is the seller for that purchase; Apple Distribution International Ltd, Hollyhill Industrial Estate, Cork, Ireland.

Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You cancel or manage the subscription in your App Store account settings, not here.

If we change a price we will tell you before it applies, and you can cancel before the change takes effect. Prices shown on this site are in US dollars and include any applicable tax.

Your right to cancel

You have 14 days to change your mind about a purchase of digital content, unless you asked for it to start straight away and agreed that you lose that right once it does.

Refunds for App Store purchases are handled by Apple through reportaproblem.apple.com. Nothing here affects your statutory rights.

If you cancel a paid plan, your messages are not deleted. Your account continues on the free plan with its limits.

Keeping the service running

We may update the app, and occasionally take it down for maintenance. If we make a significant change to what the service does, or to these terms, we will give you reasonable notice and you may close your account if you do not accept it.

Ending your account

You can delete your account in the app at any time. Deleting it erases your messages, attachments, recipients and check-in history, and nothing will ever be delivered afterwards.

We may suspend or close an account that breaks these terms, or that appears to be used unlawfully. If we do, we will tell you why where we are allowed to.

Our responsibility to you

We do not exclude our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not let us exclude, including your rights under the Consumer Rights Act 2015 to a service carried out with reasonable care and skill.

Beyond that, we are not liable for losses we could not reasonably have foreseen, and our total liability to you is limited to the greater of the amount you paid us in the 12 months before the claim, or £100.

Complaints

Email hello@nothingunsaid.app. We aim to reply within 48 hours and to resolve complaints quickly.

Law and jurisdiction

These terms are governed by the law of England and Wales, and you may bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also use your local courts.

Terms that apply because the app comes from the App Store

  • This agreement is between you and us, not Apple. Apple is not responsible for the app or its content.
  • Your licence to use the app is personal and limited to Apple devices you own or control, as set out in Apple's usage rules.
  • We, not Apple, provide support. Contact us at hello@nothingunsaid.app.
  • If the app fails to conform to any warranty, you may tell Apple, and Apple may refund the purchase price. Apple has no other warranty obligation.
  • We, not Apple, are responsible for any claim that the app infringes someone's intellectual property rights, and for product liability and legal claims about the app.
  • You confirm you are not in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not on a US Government prohibited-parties list.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
